Photographer sues Buzzfeed website for $3.6M
PHOTOGRAPHER Kai Eiselein is suing website Buzzfeed in the New York District Court for $3.6M after it distributed one of his images - which was then used without authorisation by dozens of others.
He is relying on the ability to claim "statutory damages" for works registered with the US authorities - rather than having to show actual damage from the unauthorised uses. The Freelance is inquiring how this fits with the ruling in the same court that Daniel Morel can claim only one set of statutory damages per photo, and will report back.
